The following terms (“Terms of Use”) including those additional terms and conditions and policies referenced herein and/or available by hyperlink constitute an agreement between Stars School, a product of Shoshin Tech Private Limited, registered under the Companies Act 2013 and having its operating office at T-Hub, Madhapur, Hyderabad, Telangana - 500081, hereinafter referred to as the “Company” (where such expression shall, unless repugnant to the context thereof, be deemed to include its respective legal heirs, representatives, administrators, permitted successors and assigns), and you that governs your use of this website and all of its associated services, content, and functionality. These Terms of Use apply to all users of the site, including without limitation users who are browsers, customers, merchants, and/ or contributors of content. This policy applies to the website administered by Shoshin Tech Private Limited, located at ‘stars.school’ (“Website” or “Platform”).

“We”, “Our”, and “Us” shall mean and refer to the Website and/or the Company, as the context so requires. Shoshin Tech Private Limited offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here. Further, the Platform reserves its right to suspend the account of any User for an indefinite period to be decided at the discretion of the Platform or to terminate the account of any User who is found to have created or shared or submitted any Content or part thereof that is found to be untrue/inaccurate/misleading or offensive/vulgar. The User shall be solely responsible for making good any financial or legal losses incurred through the creation/sharing/submission of Content or part thereof that is deemed to be untrue/inaccurate/misleading.

You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. Payment

The User viewing the services listed on the platform is free of cost however any such services availed by the User through the platform shall be subject to payments and the User is bound to make a payment to the company. The Company has third party payment gateways like

• Apple Pay

The Company will not be liable for any credit or debit card fraud. The liability to use a card fraudulently will be on the user and the onus to 'prove otherwise' shall be exclusively on the user. To provide a safe and secure shopping experience, the Company regularly monitors transactions for fraudulent activity. In the event of detecting any suspicious activity, the Company reserves the right to cancel all past, pending and future orders without any liability.

The Company shall disclaim all responsibility and owns no liability to Users for any outcome (incidental, direct, indirect or otherwise) from the use of the Services. The Company, as a merchant, shall be under no liability whatsoever in respect of any loss or damage arising directly or indirectly out of the decline of authorization for any Transaction, on Account of the Cardholder having exceeded the preset limit mutually agreed by us with our acquiring bank from time to time.

By using this Platform and providing his/her identity and contact information to the Company through the Platform, the Users hereby agree and consent to receive calls, e-mails or SMS from the Company and/or any of its representatives at any time.

Indemnification

Severability

Suspension of user access and activity

Notwithstanding other legal remedies that may be available, the Company may in its sole discretion, limit the User’s access and/or activity by immediately removing the User’s access credentials either temporarily or indefinitely, or suspend/terminate the User’s association with the Platform, and/or refuse to usage of the Platform to the User, without being required to provide the User with notice or cause:

• If the User is in breach any of these Terms or the Policy;

• If the User has provided wrong, inaccurate, incomplete or incorrect information;

• If the User’s actions may cause any harm, damage or loss to the other Users or to the Company, at the sole discretion of the Company.

 

Termination

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Use are effective unless and until terminated by either you or us. You may terminate these Terms of Use at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment, you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Use, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof)

 

Force majeure

Stars school shall not be liable for delays in or failure of performance hereunder due to causes beyond its reasonable control, including, but not limited to, acts of God or public enemy, acts of government in either its sovereign or contractual capacity, flood, earthquake or other natural disaster, strike or other labour disputes, acts of war, acts of civil disobedience, denial-of-services and distributed-denial-of-services, ransomware and other cyber-attacks that are not caused or facilitated by negligence (a “Force Majeure”). Any delay resulting from a Force Majeure will result in an extension of the corresponding obligation for a period equal to the time lost by reason of such cause. For instance, if the Services are unavailable for a period of two (2) weeks as a result of a Force Majeure, then the Term shall automatically be extended by two (2) weeks.

In the event of a Force Majeure, Stars school shall advise Customer without undue delays, providing Customer with reasonable information on the Force Majeure. Stars school shall resume performance as soon as possible upon the resolution of the Force Majeure.

 

Entire agreement

The failure of us to exercise or enforce any right or provision of these Terms of Use shall not constitute a waiver of such right or provision.

These Terms of Use and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Use).

Any ambiguities in the interpretation of these Terms of Use shall not be construed against the drafting party.

 

Governing law

To the fullest extent permitted by law, these Terms of Use are governed by the Internal laws of India and courts in Telangana, India will have the jurisdiction.
